What to do about poor treatment at a VA center

Jim,

WHAT ARE THE OPTIONS OF A VETERAN THAT HAS BEEN CONTINOUSLY MISDIAGNOSED AT A VA HOSPITAL IN FAYETTEVILLE NC?

THIS IS A FEMALE VETERAN, IN SHORT I WILL EXPLAIN WHAT HAS HAPPEN OVER THE YEARS.

JUST APRIL 29, 2010, SHE WAS GIVEN A INJECTION THAT NEARLY KILLED HER. SHE HAS A HEART CONDITION AND A VERY LOW HEART RATE, BRADYCARDIA, THE VA WITHOUT READING THE RECORDS GAVE HER AN INJECTION OF NUBAIN WHICH CAUSES BRADYCARDIA.

LAST JUNE 2009, THEY REMOVED HER OUT OF ICU AND PUT HER IN A BED COVERED WITH ANOTHER VETERANS BLOOD. JUST 4 DAYS AFTER THAT, THEY LOST HER BLOOD IN THE LAB, IT WAS FOR A CRITICAL DIGOXIN LEVEL TEST.

FOR OVER A YEAR SHE WAS TOLD SHE HAD GAS AND IT NEVER WAS GAS. FAYETTEVILLE VA NEVER ONCE READ THE RECORDS WHERE ANOTHER VA PUT A SHUNT CATHETER IN HER STOMACH 10 YEARS AGO. IT WAS THE 10 YEAR OLD SHUNT CATHETER CAUSING THE PAIN, NOT GAS LIKE THE VA TOLD HER FOR OVER A YEAR.

SHE WAS TOLD BY THE SAME DOCTOR THAT TOLD HER SHE HAD GAS WHEN SHE FELL AT FORT BRAGG, THAT SHE ONLY HAVE A SPRAIN, IT WAS NOT A SPRAIN, IT WAS FRACTURED.

SHE WAS PUT IN A ROOM WITH AN OXYGEN HOSE LAYING ON THE FLOOR FROM A DISCHARGED PATIENT AND STILL RUNNING ON 2 LITERS

THE LIST CAN GO ON AND ON JIM, NOT TO MENTION AN EMPLOYEE ENTERED HER ROOM TRAUMADIZING HER, WHILE SHE WAS TAKING A SHOWER AND THE EX DIRECTOR INSTRUCTED SECURITY TO NOT MAKE A REPORT.

WHEN HER HUSBAND TOOK A PICTURE WITH CELL PHONE OF THE BLOOD ON HER BED LAST YEAR, THEY USED EXCESSIVE FORCE TO TAKE HIS CELL PHONE AND DELETE THE PICTURES CAUSING EXTENSIVE BRUISING ON HIS ENTIRE UPPER BODY. JIM SCOTT WAS SENT PICTURES OF THIS ALSO.

PLEASE GIVE US SOME ADVICE LEGALLY WISE.

This is not legal advice. I'm not a lawyer. I can only tell you what I would do if I were in a similar situation.

I'm not exactly sure what sort of options you're looking for. You want to take action I'll assume.

First you must decide what you want to accomplish. Do you want money? Do you want certain people punished? Do you want a confession of wrongdoings?

You must have a goal. Define your goal before you do anything else.

Let's assume you want money. You feel you've been harmed and want to recover damages. That's fine. Now you must determine what the damages were. Usually you do that by figuring out just what harm was suffered. Losing a leg because of surgery is pretty clear. If they chopped off the wrong leg on a young person, the damages may run into the hundreds of thousands of dollars.

You must think of damages...what was the harm or damage to you?

How did the nubain nearly kill her? How can you prove that it was nubain that harmed her and not another drug? Who are your witnesses? What was the lasting damage from this event?

How was she harmed by the oxygen left running? What damages did she suffer?

You get the idea. A court and a judge will want to know all these things. You must think about it before you file a lawsuit.

If I were you, I'd pick the most harmful and damaging and longest lasting event that is on your list and only talk about that one. Let me know what you decide.
