VA disability, pension and SSDI

Question:

Jim, My domestic partner has a 40% service-connected disability, receives a pension with a non-S-C disability. He got on SSDI last July. This July, he turns 65. He's been told by the SSI office that he won't lose anything. The VA Benefits Office says he will. He's really stressed about two different answers!  Thank you!

Jim's Reply:

VA pension is a means tested benefit and that means it can rise up or down depending on any other income. Either the SSDI or the 40% rating or the combination of those 2 things could raise his yearly income high enough to eliminate any pension payment.
