Reviewing a proposed mediation agreement

Question:

I was wondering if you would take a look at a document that was drawn up by a mediator and tell me if you think it’s fair.

Jim's Reply:

No, sorry...I can't do that. I have to assume that if you were in a situation where you agreed to mediation that the process was carried out fairly and without bias. In any dispute that requires mediation someone will always be unhappy. But once we agree to mediation, that's a pretty strong commitment that we want to avoid long court proceedings so we promise to abide by the decisions of the mediator and that's that. If you feel you've been wronged, your next step is to speak with a lawyer.
