Medical marijuana is legal in my state

Question:

jim, I am a vietnam vet who just received 70% disability rating for my hearing loss on a Navy destroyer and had cancer treatments last year for a tumor under my tongue. Can the VA take away my compensation for medical marijuana use? It's legal in my state and I use it for appetite problems and insomnia. I have also filed the blue water agent orange claim as we were off the coast of Saigon when it fell.

Jim's Reply:

Marijuana isn't a consideration for VA disability benefits. VA tests every veteran at health care appointments and for most veterans that test positive for marijuana, whether legal or not, the doctor won't have any comment. If there are other drugs being abused, the veteran may be offered rehab or VA prescriptions for opioid drugs may be cut off,  but in no way does a substance like weed have any affect on disability benefits.
