Confusing comments in C & P exam

C&P Exam notes - Question about testing - not consistent nor inconsistent.

The following (or similar) statements are often used in the notes during an exam:

  • "The examination is neither medically consistent or inconsistent with the Veteran's statements describing functional loss with repetitive use over time."
  • "The examination is neither medically consistent or inconsistent with the Veteran's statements describing functional loss during flare-ups."
  • "I cannot say without mere speculation."

In a nutshell, all that means the examiner can neither support or refute your claim based on the medical exam. For example...let's say you have a claim in for a painful knee joint. If x-rays and exams are negative but you're still having problems, the statements would tell the rater that the examiner can neither prove or disprove your claim.

If you aren't happy with a C & P exam, you should wait for the decision of the rater before you try to do anything about the inadequate exam. You never know that the rating may be favorable to you...there's a lot to a decision other than the C & P exam.
