Mental Health Records

Question:

Hi Jim. Any recommendations for when your V.A. mental health doc doesn’t detail his notes with what you experiencing? I’m afraid that his lack of notes will not support my request for an increase for my already 50% MH issues or a private Nexus. Thank you for your assistance.

Jim's Reply:

Mental health records are kept confidential from the patient and the right to review these records is much different than your right to see records of your physical care. Mental health providers would often tell you that for the patient to review the clinical notes may be upsetting and interfere with the treatment plan if the patient chooses to debate what he sees. The notes your mental health provider are supposed to be factual and if so, they may or may not support your request to increase your rating.
